This Privacy Policy describes how Moonline AI, LLC ("Moonline AI," "we," "us," or "our") collects, uses, processes, stores, and protects information in connection with our AI-powered voice and phone agent services, website, and related offerings (collectively, the "Services").
This Policy applies to business customers ("Clients") and, where applicable, to individuals who interact with the Services as callers or end users.
1. Role of Moonline AI
Moonline AI acts solely as a service provider and data processor on behalf of its Clients. We do not act as a data controller with respect to end-customer personal data processed through the Services.
Clients determine:
- What data is collected
- The purposes for which it is used
- What disclosures are provided to callers
- What consents are obtained
Moonline AI processes data only in accordance with Client instructions, this Privacy Policy, and applicable law.
2. Information We Process
In the course of providing the Services, Moonline AI may process the following categories of information ("Service Data"):
2.1 Call and Communication Data
- Call recordings
- Call transcripts
- Call metadata (timestamps, duration, routing outcomes, call status)
2.2 Configuration and Operational Data
- Restaurant menus, hours, pricing, scripts
- Call routing rules and business logic
- System usage logs and performance metrics
2.3 Information Provided by Callers
- Limited information voluntarily provided during calls (e.g., name, phone number, order details)
Moonline AI does not intentionally collect sensitive personal information, biometric identifiers, or government-issued identification numbers.
3. Purpose of Processing
Moonline AI processes Service Data solely for the following purposes:
- Providing, operating, and maintaining the Services
- Responding to Client requests and support inquiries
- Improving AI accuracy, performance, and reliability
- Monitoring quality and preventing misuse, abuse, or fraud
- Maintaining system security and integrity
- Complying with legal and regulatory obligations
4. AI Training and Improvements
Moonline AI retains all rights to its AI models, systems, workflows, prompts, and analytics.
Moonline AI may use aggregated and anonymized data derived from Service Data to improve and enhance its Services, provided such data does not identify any Client or individual.
Moonline AI does not use Client-identifiable data to train third-party models or for unrelated commercial purposes.
5. No Sale or Advertising Use of Data
Moonline AI:
- Does not sell, rent, license, or trade personal data
- Does not use Service Data for third-party advertising
- Does not engage in behavioral marketing or data brokerage
6. Third-Party Subprocessors
Moonline AI may engage vetted third-party service providers ("Subprocessors") to support delivery of the Services, including:
- Telephony providers
- Cloud infrastructure providers
- AI infrastructure providers
All Subprocessors are bound by contractual confidentiality, data protection, and security obligations consistent with this Policy.
7. Data Retention
Moonline AI retains Service Data only for as long as reasonably necessary to:
- Provide the Services
- Comply with legal obligations
- Resolve disputes
- Enforce agreements
- Improve system performance
Retention periods are determined at Moonline AI's discretion, subject to applicable law and Client agreements.
8. Data Security
Moonline AI implements commercially reasonable administrative, technical, and physical safeguards designed to protect Service Data against unauthorized access, disclosure, alteration, or destruction.
However, no system is completely secure, and Moonline AI does not guarantee absolute security.
9. Client Responsibilities
Clients are solely responsible for:
- Providing legally required notices and disclosures to callers
- Obtaining consent for call recording, transcription, and AI processing
- Ensuring compliance with privacy, consumer protection, and telecommunications laws
Moonline AI disclaims responsibility for Client failures to meet legal obligations.
10. California Privacy Rights (CCPA / CPRA)
Moonline AI processes personal information exclusively as a service provider under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA).
Moonline AI does not retain, use, or disclose personal information except as permitted by law and contractual agreements.
Requests relating to consumer rights should be directed to the applicable Client.
11. Policy Updates
Moonline AI may update this Privacy Policy from time to time to reflect changes in law, technology, or business practices.
Updates will be posted on the Moonline AI website. Continued use of the Services constitutes acceptance of the updated Policy.
